Abstract
Bu çalışma klasik ceza adalet sisteminin dayandığı felsefi temelleri ortaya koyduktan sonra bu yaklaşıma yönelik eleştirileri inceleyecektir. Klasik ceza adalet felsefesi aydınlanma felsefesinin birey nosyonuna dayanmaktadır. Aydınlanmacı birey tasarımı bireyi eylemlerinin sonuçlarından sorumlu görmektedir. Klasik ceza adalet anlayışı caydırıcılığı esas alarak etkili cezaların bireyi suçtan alıkoyacağını vurgulamaktadır. Klasik ceza adalet anlayışının cezalandırmayı merkeze koyması onarıcı adalet yaklaşımı tarafından eleştirilmektedir. Artan suç oranları devletin cezaevlerine daha çok bütçe ayırması gibi noktalar onarıcı adalet yaklaşımını gündeme getirmektedir. Onarıcı adalet yaklaşımı cezadan ziyade suç sonucu kopan toplumsal ilişkileri onarmayı amaçlamaktadır. Bu bağlamda mağdurun duygularının da hesaba katılması gerektiğini vurgulayan onarıcı adalet, suçlu kadar mağduru da ön plana çıkarır. Çalışma onarıcı adalet kavramının boyutlarını irdeledikten sonra onarıcı adalet yaklaşımının öne çıkan noktalarını inceleyecektir. Çalışmada onarıcı adalet yaklaşımının cezalandırıcı adalet yaklaşımından farkları ele alınacaktır. Bu anlamda onarıcı adalet anlayışının alternatif değil tamamlayıcı bir program olarak ceza adalet sisteminde uygulanması gerektiği vurgulanacaktır.

Abstract
This study will examine the criticisms of this approach after revealing the philosophical foundations on which the classical criminal justice system is based. The classical philosophy of criminal justice is based on the notion of the individual of the Enlightenment philosophy. The notion of the enlightened individual considers the individual responsible for the consequences of his or her actions. The classical understanding of criminal justice emphasizes that effective punishments will prevent the individual from crime, based on deterrence. The classical understanding of criminal justice putting punishment at the center is criticized by the restorative justice approach. Points such as increasing crime rates and the state allocating more budget to prisons bring the restorative justice approach to the agenda. The restorative justice approach aims to repair social relations broken by crime rather than punishment. In this context, restorative justice, which emphasizes that the feelings of the victim should be taken into account, highlights the victim as much as the criminal. The study will examine the prominent points of restorative justice approach after examining the dimensions of the concept of restorative justice. In the study, the differences between the restorative justice approach and the retributive justice approach will be discussed. In this sense, it will be emphasized that the restorative justice approach should be implemented in the criminal justice system as a complementary program, not an alternative.
